1. Intellectual Property Position
CYNSUS LLC ("CYNSUS," "we," "us," or "our") respects the intellectual property of others — and we expect the same respect for ours. We credit our sources everywhere their data appears, we honor the licenses under which data is provided to us, and nearly all governmental content on the Platform is drawn from official public sources.
In return: the CYNSUS platform, its design, its compilation and enrichment of civic data, and the CYNSUS name and marks are our property and are protected by law. Scraping the Platform, republishing its content commercially, and using its content to train artificial-intelligence models are prohibited under our Terms of Service, and we enforce those protections.
2. False Claims Carry Liability
The notice process below exists for good-faith copyright claims — not as a pressure tactic. Every notice and counter-notice requires statements made under penalty of perjury, and under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing is liable for damages, including costs and attorneys' fees, incurred by CYNSUS or by the user whose content was wrongly targeted. CYNSUS reserves the right to pursue those remedies against abusive or bad-faith claims.
Note also that facts and United States government works are not subject to copyright. A notice directed at public-domain legislative or governmental data will be rejected on that basis.
3. Reporting Claimed Infringement
In accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512), if you believe in good faith that material hosted on the Platform infringes your copyright, send a written notice to our designated agent (Section 6) including all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material claimed to be infringing, with information reasonably sufficient for us to locate it (for example, the URL)
- Your contact information (name, address, telephone number, and email address)
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf
Upon receiving a valid notice, we will remove or disable access to the identified material and make a reasonable effort to notify the user who posted it.
4. Counter-Notification
If your content was removed and you believe the removal was a mistake or misidentification, you may submit a written counter-notification to our designated agent including:
- Your physical or electronic signature
- Identification of the removed material and its prior location
- A statement, under penalty of perjury, of a good-faith belief that the material was removed as a result of mistake or misidentification
- Your name, address, and telephone number, and consent to the jurisdiction of the federal district court for your judicial district (or, if outside the United States, any judicial district in which CYNSUS may be found), and consent to accept service of process from the person who provided the original notice
If we receive a valid counter-notification, we will forward it to the original complainant and may restore the material in 10 to 14 business days unless the complainant notifies us that they have filed a court action seeking to restrain the alleged infringement.
5. Repeat Infringers
In appropriate circumstances, CYNSUS will terminate the accounts of users who are determined to be repeat infringers. The same accountability applies in reverse: repeat senders of bad-faith notices may be barred from the process and pursued under Section 2.
